Subject Description

    This subject explores the nature and history of equity, equitable interests, equitable assignments, fiduciary relationships, unconscionability, undue influence, estoppel, confidential information, equitable remedies (specific performance, declarations, injunctions, account of profits and damages) and equitable defences (laches and acquiescence).

Learning Outcomes

  • explain, analyse and critique equitable concepts, doctrines and maxims
  • explain and apply equitable concepts, doctrines and maxims in a range of practical scenarios
  • communicate clearly and persuasively in writing and argue persuasively in oral submissions
  • reflect on and self-evaluate oral communication skills and knowledge in practical legal contexts

  • Written > Briefing paper - (15%) - Group
  • Written > Reflection/reflective task 1 - (5%) - Individual
  • Performance/Practice/Product > Mooting/Moot court - (30%) - Group
