Subject Description

    This subject examines the nature and scope of Commonwealth and State administrative decisions and the principles and procedures by which these decisions can be examined, reviewed and/or challenged. This will include: access to government information, including freedom of information, information privacy protection and whistleblowers; Ombudsman review; merits review, including Administrative Appeals Tribunal; judicial review under the general law and under statute; standing; and remedies.

Learning Outcomes

  • Explain key theories and concepts underpinning administrative law
  • Analyse the methods of judicial and non-judicial review available at Commonwealth and State level
  • Consider and apply complex political, social and cultural dynamics that influence the development of Australia's administrative law and appropriate reforms
