Subject Description

    Mediation is a structured process in which a third party assists two or more parties in conflict to discuss key issues and work towards a resolution or effective management of the situation or relationship. This subject introduces some of the models, theories, and standards relevant to mediation practice in Australia, and international contexts. Students will analyse some of the fundamental features of mediation and consider the legal and ethical aspects of mediation practice. Students will learn mediation process design, and how to adapt the process to a range of contexts including workplace, community, and other cultural settings. The subject will also cover contemporary issues, including dispute resolution in an online environment.

Learning Outcomes

  • Evaluate complex conflict and related theories and standards for professional practice in conflict management and resolution
  • Independently and critically reflect on and assess their own capabilities and performance, and make use of feedback as appropriate, to support personal and professional development

  • Written > Case study analysis - (50%) - Individual
  • Written > Reflection/reflective task 1 - (20%) - Individual

Special Assessment Requirements

This subject will be taught online through LearnJCU. Students must engage in online learning from the first week of the study period and throughout the entire study period. There will be online collaborate sessions scheduled throughout the semester.

Assumed Knowledge:  LB5525, LB5530, LB5531, LB5533. Note that these subjects are not required for successful completion of the subject, however are subjects in the MCMR program that students are encouraged to complete prior to commencing any elective.
