LA2021 - Personal Property and Land Law 1

This subject will be available to students from 2018. Students who require a law subject with a Personal Property Law component in 2017 are required to undertake LA3011.

Subject Description

This subject provides students with a thorough introduction to the history and context of contemporary land law in Australia. It also provides an introduction to personal property, agency and bailment. The subject uses these foundations to enable students to build a core of knowledge of key principles of land law and personal property law and it promotes the development of skills to find, interpret and apply the statute and case law that underpins these principles. The subject introduces property as a theoretical concept and covers principles including the meaning and classification of 'land' within Australian law; the classification of personal property; the doctrines of tenures and estates; the impact of native title and the Property Law Act 1974 (Qld) on these doctrines; the creation and assertion of equitable and legal interests in land; co-ownership of land and personal property; mortgages and personal property securities; and an introduction to systems of registration for interests in land; the protection of personal property under the Personal Property Securities Act 2009 (Cth); the transfer of personal property and the assertion of legal and equitable interests in personal property; principles of agency; and bailment. This subject lays a foundation for LA2016 (Land Law 2) and LA3013 (Principles of Equity).

• Resolve legal issues involving land law through analysing legal problems, and finding and applying relevant statute and case law
• Apply knowledge and legal principles to personal property and land law scenarios

Subject Assessment

• Written > Examination (centrally administered) - (70%) - Individual
• Written > Essay (including multi-draft) 1 - (30%) - Individual
