Subject Description

    This subject covers all aspects of Succession and Inheritance. It includes treatment of (a) Testate succession - wills, testamentary capacity, personal representatives, executors, grants of probate, administration of assets, legacies, payment of debts; (b) Intestate succession - the rules applicable to total and partial intestacy; grants of letters of administration; and (c) Testator's family maintenance - claims by family and dependants for support from the estate of the deceased and the power of the court to vary a will in such cases.

Learning Outcomes

  • explain and apply the law governing succession and inheritance
  • critically discuss the problems associated with the current law governing succession and inheritance and proposals for reform

Subject Assessment

  • Invigilated > End of semester exam - (70%)
  • Invigilated > Other exams - (30%)
