Nature and history of equity, equitable interests, equitable assignments, fiduciary relationships, unconscionability,undue influence, estoppel, confidential information, equitable remedies (specific performance, declarations, injunctions, account and damages) and equitable defences (laches and acquiescence).
Learning Outcomes
- explain, analyse and critique equitable concepts, doctrines and maxims;
- explain, apply and analyse equitable concepts, doctrines and maxims in a range of practical situations;
- demonstrate an understanding of, and ability to apply, relevant equitable concepts, doctrines and maxims in oral argument and in written submissions;
- speak and write clearly, coherently and persuasively;
- reflect and evaluate their learning, skills and communication of knowledge, analysis and application of the law.
Assumed Knowledge: | It is expected that Bachelor of Laws and Joint Bachelor of Laws students will have completed LA2015 Land Law 1 and LA2016 Land Law 2 before enrolling in LA3103:03 Principles of Equity. |
