This subject aims to provide students with a thorough grounding in contemporary law and policy on the nature and the operation of the Torrens system of land title and specific interests in land. It builds on the foundation knowledge about land law gained from LA2015 (Land Law 1). The subject thoroughly examines the operation of the Land Title Act 1994 (Qld), and addresses both common law and statutory regulation of mortgages, leases and easements with particular focus on the Property Law Act 1974 (Qld).
Learning Outcomes
- ability to analyse the operation of the Torrens system of land title with reference to law, policy and social change;
- ability to analyse legal problems using relevant statute and case law, to identify discrete interests in land;
- ability to find and apply relevant statute and case law to resolve conflicting claims over interests in land;
- knowledge of the policy framework informing the law relating to specific interests in land;
- skills in researching and synthesising primary and secondary sources relevant to the theory and practice of land law.
