This subject focuses on how the private law regulates conduct between members of society, primarily through the imposition of a duty to compensate for wrongfully caused harm. The tort of negligence will form the focus of study, with breach of statutory duty, survival actions, wrongful death and breach of statutory duty also canvassed. Students will continue the critique (undertaken in foundational law subjects) of the concept of fault as a basis for liability and consider how it affects contemporary society primarily in Australian jurisdictions.
Learning Outcomes
- describe some of the concepts that underpin the law of torts in particular the concept of fault and explain how the law of torts has developed in response to economic, political and societal changes;
- explain how the law of negligence and other tortious duties apply in Australia;
- apply your knowledge of the law of negligence and other tortious duties to research primary and secondary resources and respond to a range of authentic legal scenarios;
- convey information accurately and effectively in both written and oral form appropriate to the chosen audience;
- demonstrate the ability to work effectively both independently and where required collaboratively to meet assessment requirements. Identify and action learning opportunities and self-improvements.
