An introduction to traditional and contemporary philosophies of law and legal theory. The subject matter is divided into two modules traditional jurisprudence, including natural law and positivism, theories of law and justice; and contemporary critical theories, including critical legal studies, postmodernism, feminist legal theories and critical race theory.

Learning Outcomes

• acquire a general knowledge and understanding of many of the major legal philosophies relevant to the Anglo-Australian legal system;
• appreciate the value of legal theory as a key to understanding the law;
• be inspired to critically evaluate the law;
• be inspired to question the neutrality of the law;
• develop communication and problem solving skills;
• recognise philosophical assumptions in the law;
• understand the historical development of the law in the context of the development of jurisprudence.
