Introduction to judicial review of administrative action and statutory remedies.Major topics include: theory of government and administrative review; ultra vires; natural justice; remedies; Administrative Decisions (Judicial Review) Act; Administrative Appeals Tribunal Act; freedom of information; ombudsman; corruption Whistleblowers Act.
Learning Outcomes
- to introduce students to the law which seks to control administrative excess in government bureaucracies;
- to examine the legal principles which ensure that governments are accountable to communities, citizens, organisations, courts, tribunals and ombudspersons;
- the course will draw from the common law, government inquiries and policies to explain the legislation.
