This course covers the main elements of employment and labour law as well as key issues and emerging questions. Specific matters included are: The basis of Employment Law and the Legal Philosophy behind the legislation; The Employer versus Independent Contractor including the duties implied into the employment relationship and employment law policies; Termination of Employment - the common law remedies; transmission of business; rights of employees after employer insolvency, and unfair dismissal; Key elements of Work Choices - The Constitutional Challenge; effects on the State jurisdiction; Trade Union Law and bargaining under Work Choices. The subject also examines bodies the Workplace Ombudsman and the Workplace Authority.
Learning Outcomes
- understand the common law and statutory bases of employment law;
- understand the rights, duties and liabilities of the parties to an employment contract;
- understand the process of termination of employment;
- understand the operation of the Work Choices legislation.
