This subject aims to introduce students to a range of fundamental concepts that lie at the foundation of substantive law. It will provide students with a means of understanding the concepts and organising principles upon which the major substantive branches of the law are built. By relating fundamental concepts to specific areas of substantive law, students will be able to develop a map of the way in which the various branches of the law have evolved, and are both related and differentiated.
Learning Outcomes
- ability to identify key concepts and organising principles which inform the body of positive law;
- ability to analyse and critique legal arguments from the perspective of underlying principle;
- develop an awareness of the philosophical assumptions which inform and limit the development and application of law;
- develop an awareness of law as consisting of distinct branches and an ability to differentiate between these branches;
- ability to apply a conceptual understanding of law to the solution of particular problems.
