This subject provides students with a thorough introduction to the institutions and processes that influence the ongoing development of law in Australia, their history, context and contemporary relevance. It equips students with the skills necessary to find, interpret and apply law in both its legislative and adjudicative modes. Topics covered include: Australian legal history; constitutional arrangements and judicial and legislative law-making and interpretation.
Learning Outcomes
- describe the ways in which formal law-making bodies function in the Australian context;
- analyse and critique current legal issues within the context of historical influences on the development of law;
- develop specific skills in interpreting and applying statutory enactments;
- develop specific skills in reading and applying judicial precedents;
- develop an awareness of Australian constitutional and legal history and its influence on the process and history of law in Australia.
