An introduction to traditional and contemporary philosophies of law and legal theory. The subject matter is divided into two modules - traditional jurisprudence, including natural law and positivism, theories of law and justice; and contemporary critical theories, including critical legal studies, postmodernism, feminist legal theories and critical race theory.

Learning Objectives:

acquire a general knowledge and understanding of many of the major legal philosophies relevant to the Anglo-Australian legal system;

understand the historical development of the law in the context of the development of jurisprudence;

recognise philosophical assumptions in the law;

appreciate the value of legal theory as a key to understanding the law;

be inspired to critically evaluate the law;

be inspired to question the neutrality of the law;

develop communication and problem solving skills.

Assessment by seminar participation (20%); assignment (20%); final examination (60%) (subject to variation).
