39 contact hours. First semester.
Available to LLB and joint degree LLB students.
This is a skills based subject with the primary objective being the development of effective professionals who can set aside personal biases in order to broadly and properly understand the underlying legal principles of health law. Topics include social issues and regulation of health care in Australia; confidentiality; consent to medical treatment; professional liability; reproduction; reproductive technology; surrogacy; genetics; euthanasia; living will legislation; human tissue and organs and complaints against health care professionals.
Learning Objectives:
- interaction between the law, medicine and other forces such as ethics in Australian society;
- an understanding of Queensland’s health laws; comparisons and other jurisdictions;
- distinguishing between ‘law in the books’ and ‘law in action’; and integrating conflicting perspectives;
- assess the implications of health issues for Queensland law reform, policy and practice.
Assessment by on-course assessment (50%); research paper (50%). (Subject to variation.)
