Advanced Administrative Law

Available to LLB students.

Theories of judicial review of administrative action in a democratic society; comparative study of who may challenge government decision-making (standing under the common law and statute); accountability of government; freedom of speech; the impact of international law on administrative decision making; review of refugee determinations in Australia, the US and Canada.

Learning Objectives:

  1. acquire a deeper understanding of the operation of administrative law and be able to compare the Australian experience with that of other jurisdictions;
  2. acquire an understanding of the role of the courts in government decision-making.

Assessment by two research papers (50% each) (subject to variation).
