Conflict of Laws

Available to LLB students. It is essential for those who seek admission to the Bar. It will be offered provided there are a suitable number of students.
Problems associated with the intrusion of a foreign system of law, including jurisdiction, recognition and enforcement of foreign judgments, domicile, choice of law, substance, procedure and methods of dealing with conflict of law problems. Problems in the areas of family law, property law, contract, torts, succession and estate administration will be included. Law reform initiatives will be explored.
Learning Objectives:
- to familiarise students with the problems set out above, by means of studying case law and legislation in each substantive area. The focus of study is case-based hypothetical problems.
Assessment by oral and written seminar presentation (20%); final examination (80%) (subject to variation).
