The subject considers both State and Federal Constitutional structures and focuses on the powers of the Commonwealth Parliament to make laws for Australia. The issue of Republicanism is also addressed.
Learning Objectives:
- the structure of the Commonwealth Government and Commonwealth Constitution, including the notion of responsible government and the separation of powers doctrine;
- The operation of the Queensland Constitution and its differences from the Commonwealth Constitution;
- the arguments for and against a Republic;
- the limitations on the Commonwealth Parliament to make laws affecting the Australian states and Australian citizens.
Assessment by tutorial attendance and performance (10%); assignment (20%); examinations (70%) (subject to variation).
